4.2 Domain Registration

• Domains are registered through third-party registrars and subject to their policies.
• You are responsible for renewing your domain before it expires.

4.3 Email Hosting

• You must not use our email services for spam or illegal activities.

5. Acceptable Use Policy (AUP)

By using our services, you agree NOT to:

• Engage in illegal, abusive, or harmful activities.
• Use our services for spamming, phishing, or fraud.
• Host malware, viruses, or any security threats.
• Violate intellectual property laws by hosting copyrighted material.
• Host adult content, hate speech, or violent material.
• Overload servers or disrupt service for other users.

Violation of these terms may result in immediate account termination.

6. Payment & Billing

• Payment Methods: We accept major credit cards, PayPal, and other payment methods.
• Billing Cycle: Services are billed monthly, quarterly, or annually, based on your selected plan.
• Late Payments: Accounts not paid within 7 days may be suspended.
• Refunds: We offer a 30-day money-back guarantee for shared hosting services. Refunds do not apply to domain registrations or SSL certificates.

7. Data Backup & Security

• We perform regular backups, but you are responsible for maintaining your own backups.
• We are not liable for any data loss due to system failures, hacking, or user errors.

8. Suspension & Termination of Services

We may suspend or terminate your account if:

• You fail to pay for services on time.
• You violate any terms outlined in this Agreement.
• We detect suspicious or illegal activities associated with your account.

Termination due to policy violations does not qualify for a refund.

9. Limitation of Liability

• OmegaHost LLC is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services.
• We do not guarantee 100% uptime, though we strive for the highest level of reliability.

10. Indemnification

You agree to indemnify and hold OmegaHost LLC harmless from any claims, damages, or legal expenses arising from:

• Your use of our services.
• Violation of this Agreement.
• Any third-party claims related to content you host on our servers.

11. Intellectual Property

• All website content, logos, and designs are the property of OmegaHost LLC.
• You may not copy, modify, or distribute our content without written permission.

12. Domain Name Services

• Registrations: Domains are assigned on a first-come, first-served basis.
• Renewals: You are responsible for timely renewal to avoid domain loss.
• Transfers: Domains may be transferred following ICANN policies.

13. Third-Party Services

• We may provide services integrated with third-party providers.
• We are not responsible for their performance or privacy policies.

14. Dispute Resolution

• Governing Law: This Agreement is governed by the laws of the State of Kentucky, USA.
• Arbitration: Any disputes shall be resolved through binding arbitration in Richmond, Kentucky.
• Class Action Waiver: You waive the right to participate in class-action lawsuits.

15. Modifications to This Agreement

• We reserve the right to update this Agreement at any time.
• Changes will be posted on our website, and continued use of our services signifies acceptance.
